ELECTRONIC SMOKING DEVICES – Adds to existing law to establish an electronic smoking device directory.

The purpose of this legislation is to amend Chapter 57, Title 39, of the Idaho Code to establish a directory of electronic smoking devices that may be sold in Idaho and related requirements for manufacturer certification. It also provides for penalties to retailers, manufacturers, and wholesalers who sell products not included in the directory. Fees and penalties collected by the department pursuant to the legislation will be used for related administration and enforcement. The legislation also declares an emergency and provides an effective date.

If enacted, it is estimated that this program will generate between $300,000-$500,000 in fees to manufacturers that will be used to administer the program. There should be no negative impact to the state general fund or local units of government.
